Article II - Major Sanction Appeals and Grievances

SECTION 1 - Faculty Review Panel for Sanction Appeal and Grievances

The Faculty Review Panel for sanction appeals and grievances is comprised of the Faculty Liaison Committee (FLC) members and staff of the Office of Human Resources. See Appendix M for detailed faculty grievance procedures.

SECTION 2 - Major Sanction Appeals

A faculty member who believes that a major sanction has been unjustly imposed may petition the review panel as may be appropriate. This shall not delay the imposition of the major sanction, but the review panel may recommend to the provost that the action should be reversed (e.g., the faculty member should receive payment for the period of suspension). The provost shall make the final determination.

SECTION 3 - Faculty Grievances Related to Termination of a Probationary Appointment or of Other Non-tenure Track Faculty

If a probationary tenure-track faculty or a nontenure-track member feels that they have cause for a grievance related to termination, they may request formal proceedings with the Faculty Review Panel to hear their case.

SECTION 4 - Faculty Grievances Not Related to Employment

If any faculty members feels that they have cause for grievance in any matter not covered by the procedures, in the foregoing regulations - such matters as salaries, assignment of space or other facilities, and propriety of conduct - they may petition the Office of Human Resources (HR) to convene a review panel that consists of FLC members and HR for redress.

Notwithstanding the foregoing sections, if the administration determines that the grievance involves any potential legal claims (e.g., discrimination, unequal pay), then the Office of Human Resources will handle the entire process directly and the review panel will have no authority. The review panel's findings will be transmitted to the president, whose decision is final.
